DCM Advent Calendar 2024 Terms & Conditions

1. Outlined below are the general terms and conditions (“Terms and Conditions”) which apply to the Digital Cinema Media Limited (“DCM”) 2024 Advent Calendar Competition (the “Competition”), which will run each day from Monday 2 December (the start date) to Tuesday 24 December (the closing date).

2. Anyone who enters the Competition (an “Entrant”) will be deemed to have understood these Terms and Conditions and, by entering, agrees to be bound by them. These Terms and Conditions are available on request from DCM.

3. To enter the Competition, an Entrant must enter using their work email address on the Advent.Make.As platform (and will be communicated to at that email address for the purposes of the Competition), and Entrants must be able to confirm that they are an employee of a media agency or advertising client of DCM. Responses that are sent from personal email accounts will not be considered to be valid entries. There is no cost to enter.

4. The Competition will run on weekdays from Monday 2 December until Tuesday 24 December. The Competition will not run on Saturdays or Sundays.

5. Entry will open at 10am on each day of the Competition and close at 5pm (the “Closing Time”) on that same day, and will be repeated throughout the duration of the Competition. All Competition entries received after the Closing Time on each day will not be considered to be valid entries for the Competition on that day. A winner for each of the daily prizes will be drawn at random and announced by midday on the following working day. All winners from a Friday will be announced on the following Monday at midday. Winners for Tuesday 24 December will be announced on Monday 30 December, with prizes sent within three-four working days.

Eligibility:

6. By entering the Competition, each Entrant confirms that they are eligible to do so and eligible to claim any prize they may win. DCM may require any Entrant to provide proof that they are eligible to enter the Competition.

7. All Entrants must be able to confirm that they are an employee of a media agency or advertising client of DCM in order to be eligible. Additional eligibility requirements may apply, as may be notified by DCM from time to time.

8. Entry is restricted to one entry per person per day; duplicate daily entries will not be considered to be valid entries for the Competition on that day.

9. Entrants for the daily Competition when the prize is an alcoholic drink must be able to prove that they are over the age of 18 at the time of entry, and no persons under the age of 18 will be eligible to win or receive any alcoholic drink prizes.  Any entry by a person under the age of 18 will not be considered to be a valid entry for the Competition on that day.

10. DCM will not accept Competition entries that are:

(a) automatically generated by a computer or bot;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with; or

(e) incomplete.

Any such entries will not be considered to be valid entries for the Competition.

Prizes:

11. Prizes for each day’s Competition are chosen at the discretion of DCM, and all prospective entrants will be notified of the prize(s) on offer for each day before being invited to participate in the Competition for that day. DCM is not responsible if a daily notification is not sent. Prizes will be sent via special delivery to winners at their chosen postal address in the UK within three-four working days of the announcement of the winner. The DCM team will be in touch with the chosen winners to confirm and organise details for the distribution of the prizes. DCM reserves the right to announce winners publicly on social media channels, and the Entrant permits DCM (and grants DCM all rights necessary) to use the winning Entrant’s name and the names and/or trade marks of the employer of the winning Entrant solely for the purposes of making any such public announcements. Any winning Entrant that does not wish to be included in any public announcement must immediately notify DCM in writing of their objection upon being notified that they have won a prize, and DCM will not include the name of any such winner in any public announcement following receipt of any such objection (and will remove any previously published public announcement within a reasonable time of receiving a removal request from a winner).

12. Prizes are subject to availability and DCM reserves the right to substitute the prize from a particular day with an alternative prize of equal or higher value if circumstances beyond DCM's control makes it necessary to do so. There will not be a cash alternative for any prize.

13. For prizes which are or include tickets to an event or vouchers for travel services, DCM is not eligible to provide or cover any additional accommodation or expenses.

14. For prizes which may include subscription services, DCM is not eligible to cover the cost of any services further than those specified by DCM in the communications of the prize.

15. DCM will take reasonable steps to ensure that each prize will not cause harm to the winner. However, each Entrant acknowledges that the prizes are not manufactured or produced by DCM and that DCM does not have input or control over the manufacture or production of each prize. Each Entrant must comply at all times with all health and safety and consumer advice provided by the manufacturer and/or supplier of the prizes as set out in any literature, promotional materials or product labels relating to those prizes.

16. Once a prize has been received. the Competition winner has discretion as to what to do with the prize, however the prize will not be exchanged for a cash alternative and will only be exchanged in the case of fault upon first usage of the prize.

17. The decision of DCM with regards to prizes is final and no correspondence or discussion will be entered into.

18. The winners of a prize must claim their prize on or before 31 January 2025, otherwise any prize not claimed after that date will be forfeited.

Data Protection and Publicity:

19. Each Entrant permits DCM (and grants DCM all necessary rights) to use their work email address for the purposes of registering and communicating with each Entrant for the purposes of the Competition. DCM will comply at all times with all applicable data protection laws in the operation of the Competition and will process the personal information of any Entrant or prospective entrant as set out in the Privacy Policy available here. General

21. If there is any reason to believe that there has been a breach of these Terms and Conditions, DCM, at its sole discretion, reserves the right to exclude any breaching Entrant or prospective entrant from participating in the Competition and the entry/ies of any such person will not be considered to be valid entries for the Competition.

22. DCM reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.

23. Insofar as is permitted by law, DCM, its representatives, agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss or damage occurring as a result of taking up the prize or entering or attempting to enter any Competition, except where it is caused by the negligence of DCM, its representatives, agents or distributors or that of their employees. The statutory rights of each Entrant are not affected.

24. These Terms and Conditions will be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
