DCM Advent Calendar 2024 Terms & Conditions

1. Outlined below are the general terms and conditions (“Terms and Conditions”) which apply to the Digital Cinema Media Limited (“DCM”) 2024 Advent Calendar Competition (the “Competition”), which will run each day from Monday 2 December (the start date) to Tuesday 24 December (the closing date).

2. Anyone who enters the Competition (an “Entrant”) will be deemed to have understood these Terms and Conditions and, by entering, agrees to be bound by them. These Terms and Conditions are available on request from DCM.

Details of the Competition:

3. To enter the Competition, an Entrant must enter using their work email address on the Advent.Make.As platform (and will be communicated to at that email address for the purposes of the Competition), and Entrants must be able to confirm that they are an employee of a media agency or advertising client of DCM. Responses that are sent from personal email accounts will not be considered to be valid entries. There is no cost to enter.

4. The Competition will run on weekdays from Monday 2 December until Tuesday 24 December. The Competition will not run on Saturdays or Sundays.

5. Entry will open at 10am on each day of the Competition and close at 5pm (the “Closing Time”) on that same day, and will be repeated throughout the duration of the Competition. All Competition entries received after the Closing Time on each day will not be considered to be valid entries for the Competition on that day. A winner for each of the daily prizes will be drawn at random and announced by midday on the following working day. All winners from a Friday will be announced on the following Monday at midday. Winners for Tuesday 24 December will be announced on Monday 30 December, with prizes sent within three-four working days.

Eligibility:

6. By entering the Competition, each Entrant confirms that they are eligible to do so and eligible to claim any prize they may win. DCM may require any Entrant to provide proof that they are eligible to enter the Competition.

7. All Entrants must be able to confirm that they are an employee of a media agency or advertising client of DCM in order to be eligible. Additional eligibility requirements may apply, as may be notified by DCM from time to time.

8. Entry is restricted to one entry per person per day; duplicate daily entries will not be considered to be valid entries for the Competition on that day.

9. Entrants for the daily Competition when the prize is an alcoholic drink must be able to prove that they are over the age of 18 at the time of entry, and no persons under the age of 18 will be eligible to win or receive any alcoholic drink prizes.  Any entry by a person under the age of 18 will not be considered to be a valid entry for the Competition on that day.

10. DCM will not accept Competition entries that are:

(a) automatically generated by a computer or bot;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with; or

(e) incomplete.

Any such entries will not be considered to be valid entries for the Competition.

Prizes:

11. Prizes for each day’s Competition are chosen at the discretion of DCM, and all prospective entrants will be notified of the prize(s) on offer for each day before being invited to participate in the Competition for that day. DCM is not responsible if a daily notification is not sent. Prizes will be sent via special delivery to winners at their chosen postal address in the UK within three-four working days of the announcement of the winner. The DCM team will be in touch with the chosen winners to confirm and organise details for the distribution of the prizes. DCM reserves the right to announce winners publicly on social media channels, and the Entrant permits DCM (and grants DCM all rights necessary) to use the winning Entrant’s name and the names and/or trade marks of the employer of the winning Entrant solely for the purposes of making any such public announcements. Any winning Entrant that does not wish to be included in any public announcement must immediately notify DCM in writing of their objection upon being notified that they have won a prize, and DCM will not include the name of any such winner in any public announcement following receipt of any such objection (and will remove any previously published public announcement within a reasonable time of receiving a removal request from a winner).

12. Prizes are subject to availability and DCM reserves the right to substitute the prize from a particular day with an alternative prize of equal or higher value if circumstances beyond DCM's control makes it necessary to do so. There will not be a cash alternative for any prize.

13. For prizes which are or include tickets to an event or vouchers for travel services, DCM is not eligible to provide or cover any additional accommodation or expenses.

14. For prizes which may include subscription services, DCM is not eligible to cover the cost of any services further than those specified by DCM in the communications of the prize.

15. DCM will take reasonable steps to ensure that each prize will not cause harm to the winner. However, each Entrant acknowledges that the prizes are not manufactured or produced by DCM and that DCM does not have input or control over the manufacture or production of each prize. Each Entrant must comply at all times with all health and safety and consumer advice provided by the manufacturer and/or supplier of the prizes as set out in any literature, promotional materials or product labels relating to those prizes.

16. Once a prize has been received. the Competition winner has discretion as to what to do with the prize, however the prize will not be exchanged for a cash alternative and will only be exchanged in the case of fault upon first usage of the prize.

17. The decision of DCM with regards to prizes is final and no correspondence or discussion will be entered into.

18. The winners of a prize must claim their prize on or before 31 January 2025, otherwise any prize not claimed after that date will be forfeited.

Data Protection and Publicity:

19. Each Entrant permits DCM (and grants DCM all necessary rights) to use their work email address for the purposes of registering and communicating with each Entrant for the purposes of the Competition. DCM will comply at all times with all applicable data protection laws in the operation of the Competition and will process the personal information of any Entrant or prospective entrant as set out in the Privacy Policy available here. See also Rule 9 with regards to the announcement of winners.

General

21. If there is any reason to believe that there has been a breach of these Terms and Conditions, DCM, at its sole discretion, reserves the right to exclude any breaching Entrant or prospective entrant from participating in the Competition and the entry/ies of any such person will not be considered to be valid entries for the Competition.

22. DCM reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.

23. Insofar as is permitted by law, DCM, its representatives, agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss or damage occurring as a result of taking up the prize or entering or attempting to enter any Competition, except where it is caused by the negligence of DCM, its representatives, agents or distributors or that of their employees. The statutory rights of each Entrant are not affected.

24. These Terms and Conditions will be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

Limited Anti-slavery and human trafficking statement

The Modern Slavery Act 2015 (Act) requires any commercial organisation in any sector, which supplies goods or services, and carries on a business or part of a business in the United Kingdom, and is above a specified total turnover, to produce and publish an annual slavery and human trafficking statement.

This statement relates to the actions and activities of Digital Cinema Media Limited (Company) and all of its subsidiaries during the financial year 1 January 2022 to 31 December 2022 (DCM’s financial year ended on 22nd December 2022). Where the context so requires, references in this statement to the Company include references to the Company and all of its subsidiaries from time to time. The Company is committed to the prevention of the use of forced labour and has a zero-tolerance policy for human trafficking and slavery.

  1. Organisational structure
    Digital Cinema Media is the market leader in UK cinema advertising, providing over 3,500 screens at over 500 sites for advertisers. The Company sells 80.1% of the cinema advertising market through exhibitors including Cineworld, ODEON, Vue, Picturehouse Cinemas and many independent cinemas. The Company employs around 65 staff members who are all based in the UK. The vast majority of the Company’s exhibitors are well known UK brands.
  2. Our policies on slavery and human trafficking
    1. The Company will not use or allow the use of forced, compulsory labour, slavery, servitude or human trafficking in the course of its business.  This includes sexual exploitation, securing services by force, threats or deception and securing services from children and vulnerable persons.
    2. The Company operates the following policies which are relevant to the prevention of slavery and human trafficking in its operations:
      1. Anti-slavery and human trafficking policy – this policy sets out the steps that the Company has taken, and will take, to prevent human trafficking and slavery within its business and its supply chain.
      2. Employment Policy - Employment terms and conditions for the Company’s employees based at its UK offices are regulated by and are operated in compliance with all relevant prevailing legislation. Employment terms and conditions provided to staff are better than the national average. The Company is recognised by both The Sunday Times and Campaign Magazine as a Best Place to Work and for creating an environment where people love to come to work.
    3. In addition, internal policies are reviewed regularly to ensure continued compliance with the Modern Slavery Act 2015.
  3. Due diligence processes for slavery and human trafficking
    The Company believes that in order to prevent human trafficking and slavery within its business and its supply chain it is necessary to first understand the areas where the Company is most at risk. Due to the Company’s exclusively UK based operations and the fact that its suppliers are mostly large UK based cinema chains the Company believes that the risk of modern slavery occurring in its business or in its supply chain are very low. The Company is, however, committed to ensuring that that is, and remains, the case and has implemented systems to:
    1. continually seek to identify and assess potential risk areas in the Company’s business and supply chains; and
    2. protect whistleblowers.
  4. Supplier adherence to our values and ethics
    1. Efforts are made to confirm that the Company’s suppliers are as committed to the prevention of human trafficking and slavery as the Company, and each supplier’s conduct is carefully considered when awarding or renewing business.
  5. Performance indicators
    The Company will use the following key performance indicators to measure how effective it is in ensuring that slavery and human trafficking is not taking place in any part of its business or supply chain:
    1. completion of necessary training of the policy by all relevant staff;
    2. communication of the policy to suppliers; and
    3. the response time and remedial actions taken by the Company in respect of any reported case of modern slavery or human trafficking within its business or supply chain.

    This statement will be reviewed annually by Jemma White.

This statement is made pursuant to section 54(1) of the Act and constitutes the Company’s anti-slavery and human trafficking statement for the financial year ended 31 December 2018.

What cinemas are in DCM’s portfolio?

DCM has an 80.1% admissions share of all cinemas across the UK, the main circuits include:

What is a UKCA cinema?

The UK Cinema Association (UKCA) is the national trade association for cinema operators in the UK. The UKCA represents the interests of over 90% of the UK cinema operators. The UKCA advocates on behalf of the UK cinema sector at international, national, and regional level. It lobbies the Government along with other sectors of the UK film industry, particularly distribution, also working with others within the industry to promote the value of cinema to the public. In addition it provides advice and support to individual members on interpreting and adhering to legislation and regulation, and in dealing with day to day operational issues when appropriate.

Who are the CAA?

The Cinema Advertising Association (CAA) is the trade association of cinema advertising contractors operating in the UK. One of the functions of the CAA is to monitor and maintain standards of advertising exhibition in the UK and the Republic of Ireland.

The CAA recognises the guidelines for commercial content as outlined in the UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing (the CAP Code) which is policed by the Advertising Standards Authority, and the Code of Standards for Advertising, Promotional and Direct Marketing in Ireland (the ASAI code).

The CAA maintains a Copy Panel to ensure that all cinema commercials are suitable within the appropriate guidelines.

How long should I allow for copy clearances, and how much does that cost?

CAA & BBFC advise a lead time of 48 hours for clearance, however potentially contentious copy which might require an age restriction is referred to a Friday morning Panel meeting so please bear this in mind if your copy deadline is mid-week, not on a Friday.

What is an AGP?

An Audience Guaranteed Package (AGP) is Cinema’s most popular buying route as it’s the broadest, most cost-effective way of reaching the whole cinema audience in any given campaign period. An AGP will run with all available films showing over your selected dates with guaranteed admissions. AGPs can be bought on a national or regional basis.

How are admissions tracked?

We receive live exhibitor admissions each morning for the previous 24 hours which are then reconciled against individual campaigns, allowing us to provide regular updates on how a campaign is tracking.

What if a film moves?

There are a number of options should your film move;

  • Campaign moves in line with new release date
  • New and relevant title replaces previous film
  • Admissions are banked for a later date

Do you offer premium positions in the ad-reel alike to TV? First in break, last in break etc.?

Yes.

Silver Spot: Positioned after the DCM closing ident, and just before the start of the trailers

Bronze Spot: A premium fixed position at the very end of the main ad reel just before the closing DCM ident

What if my campaign fails to deliver?

All attempts will be made to ensure admissions are delivered, this may include any or all of the following — opening up titles selected, broadening regions or extending the campaign.

Admissions that aren’t delivered will be banked and they will be able to be used again within a 12 month period. For further details please click here.

Is the creation of the ad included in your costs? If not, do you offer any creative services?

The creation of the ad is not included in our production costs, which are solely for the conversion of the ad to cinema format (Digital Cinema Package - DCP) and the associated distribution to cinemas.

Whilst we do not currently offer creative services in-house we can recommend suitable production companies and sound studios who’ll be able to quote for a range of creative services.

What are your time-length factors if I’m not running a 30” ad?

What is a DDU and a transfer fee in relation to production?

The transfer is the process of converting the ad to Digital Cinema Package (DCP) format, the industry standard for digital cinema projection.

DDU stands for Digital Distribution Unit and is the cost associated with sending the final DCP to the individual cinema screens.

How long does your production process take and what is actually involved in the DCM production process?

The standard cinema production process takes one working week. As a norm, campaigns start on a Friday as this is the start of the cinema week so lead time runs Friday to Friday. For campaigns starting on any other day of the week please speak to your DCM representative to confirm your cinema deadlines.

The cinema production process involves converting the ad to Digital Cinema Package (DCP) format, a private approval screening for the client and / or creative agency to sign off prior to distribution, and lastly distribution to cinemas as per the requirements of the campaign.

How much does it cost to get a Dolby mix?

The Dolby mixing cost is not included in DCM’s production costs, and is a variable cost dependent on length and complexity.

Sales Terms & Conditions

Effective from 1 February 2016

INTRODUCTION

The agreement between Digital Cinema Media Limited (“DCM”) and each Buyer relating to the purchase of Advertising Inventory is contained in these Terms and Conditions together with the corresponding Trading Agreement (“Agreement”).

These Terms and Conditions apply to the purchase of all Advertising Inventory after 1 February 2016.

The Buyer signifies that it accepts and agrees to be bound by the Agreement by placing a Space Request with DCM for Advertising Inventory and confirming that Space Request verbally, in writing, electronically or otherwise.  Space Requests will be accepted by DCM pursuant to clause 5. No amendment to the Agreement will be binding or effective unless agreed in writing by DCM.

In the event of any conflict between these Terms and Conditions and the Trading Agreement, the Trading Agreement will prevail.
